The meeting was opened with a word of prayer from Lady Justice Jackline Kamau, after the
East Africa Community Anthem.
Min. 4/2/2019 Communication from the Chair:
The meeting was chaired by Hon. Justice Robert Makaramba, who started by thanking
members who managed to attend the meeting. He equally gave gratitude to the Gender Subcommittee for toiling to come up with a draft Gender Policy as well as ICJ-K for facilitating the
Min. 5/2/2019 Reading and Confirmation of minutes of the previous meeting
Minutes of the Council Meeting held at Gorrillas Hotel in Kigali, Rwanda, on 30th March, 2019,
were read and corrections made. The same were then proposed by Hon. Rumisha and
seconded by Hon. Kagoya.
Min. 6/2/2019 KCB Account activation
Hon. Khaemba informed members that the KCB account was still blocked for debits as the
process of reactivation had not been finalized. It was the resolution of the meeting that the
said process be finalized if possible before the end of the term of Council.
Min. 7/2/2019 EAMJA Office Running Expenses
The meeting was informed by Hon. Luhwago that the EAMJA Office in Arusha was now
operational after the Judiciary of Tanzania seconded Hon. Teresia Sedoyeka, Resident
Magistrate, as the Office Administrator. With that, the meeting resolved that JMAT meets the
expenses of running the office as well as monthly stipends to the Office Administrator subject
to a set-off, with supporting documents until the next Council’s tenure.
Min. 8/2/2019 Mombasa EAMJA Conference, 2018
Justice Musoke, Hons Kaweesa and Kagoya informed the meeting that the 50 people who
travelled to Mombasa from Uganda allegedly to attend the 2018 Mombasa EAMJA
Conference were in fact on their own trip and that there must have been a communication
breakdown. Justice Kamau, on behalf of KMJA accepted the explanation and stated that
KMJA would absorb the costs incurred.
Min. 9/2/2019 Reports
Justice Jackline Kamau gave a detailed written report on the state of the Judiciary in Kenya,
with the following key highlights:-
She reported that judicial independence was still being undermined in Kenya, especially
through budgetary cuts as well as the clamor to change the Constitution.
She further reported that the Judiciary of Kenya had developed a number of strategies on
reduction of case backlogs, which included judicial service weeks, court annexed mediation
and digitization of judiciary processes especially in the Family and Commercial Divisions of
the High Court in Nairobi.
Justice Kamau also informed the meeting that the Judiciary of Kenya had conducted
interviews and promoted several magistrates to senior positions as well as several High Court
Judges to the Court of Appeal.
Hon. Kaweesa started by informing the meeting that the “Mbale Judgement” which extended
the term limit of President Yoweri Museveni had been appealed against at the EACJ.
He also reported that there was an Administration of the Judiciary Bill pending before
parliament, whose is main objective is to give the Judiciary iof Uganda total financial
It was further reported that there was salary increment for judicial officers from July, 2019 and
that all judicial officers were going to be provided with motor vehicles as well as housing
Hon. Salum Bakar reported that on 6th April, 2019, ZAJOA conducted its Annual General
Meeting whereby several issues relating ti the Association were discussed and resolved.
He also reported that on 21st and 22nd June, 2019, ZAJOA members attended a two days
course on criminal and civil procedures which was held at Visitors Inn Hotel, Jambiani,
Hon. Salum further reported that on 8th-19th July, 2019, the CJ of Zanzibar visited all prisons
and talked to prisoners and remandees in order to know their challenges
Hon. Luhwago informed the meeting that JMAT had resolved to retain Justice Makaramba,
who retired from the Judiciary of Tanzania on 30th April, 2019, as EAMJA Vice-President until
the term of office of the current Council comes to an end.
About the new EAMJA Office Administrator, Hon. Sedoyoka, Hon. Luhagwo requested that
she be given an Appointment letter by the EAMJA, stating her job description and other Terms
of References as well as her entitlement.
Hon. Luhagwo also reported that the Tanzania Judiciary had opened two new High Court
Registries, one in Kigoma and the other in Mara.
Min. 10/2/2019 Adoption of the Gender Policy
The meeting resolved that the Consultant be informed on when to come up with a final draft
of the Gender Policy for submission to the AGM and adoption.
Min. 11/2/2019 Updates on the Upcoming EAMJA AGC/AGM
Hon. Salum gave a list of hotels which will provide accommodation to the delegates, including
the venue of the Conference.
The meeting further resolved to have the names of presenters sent to the SG by the end of

Hon. Kaweesa proposed that the out-going Council Members be given certificates of
service/plaque as appreciation for service rendered.
It was suggested by Justice Musoke that Justice Makaramba who had since retired be
considered for Honorary Membership due to his outstanding service to Council.
Hon. Rumisha on his part proposed that similar treatment be extended to other past officials
of Council. The meeting then resolved that the issue be placed before the next Council
meeting for discussion as a substantive agenda and the names of candidates be provided
It was also proposed that the website host be relooked at because services being offered
appears to be substandard.
About the upcoming EAMJA elections, the meeting tasked Hon. Rumisha to look at the
previous practice on allocation of positions to member countries for consideration in the next
There being no other business, the meeting ended at 5pm with a prayer from Hon. Salum,
and the next meeting was fixed for 21st October, 2019 in Zanzibar
